    People have long argued that tinctures extracted from marijuana plants are far superior to those of hemp plants—but that was before CBD’s significance was recognized by the medical community. With all we now know about its properties, extraction methods and cannabinoid ratios, hemp tinctures are holding their own.

     

    Fundamentally, marijuana and hemp are both cannabis plants containing the same cannabinoids, just in different ratios and quantities. Hemp contains only negligible amounts of THC, while some marijuana has upwards of 30% THC.

     

    Hemp CBD, on the other hand, can be just as potent as marijuana CBD when properly extracted. It does require a lot more hemp, processing and money to produce the same amount as cannabis-dervied CBD, so the former is naturally more expensive.

    There are several ways to make your own CBD tincture, but almost all of them involve high-proof alcohol and/or a crock-pot, which seem like a recipe for disaster. Instead, we’d like to present our own proprietary high-quality, alcohol-free tincture recipe.

     

    Wait, isn’t alcohol in the very basis of tincture? Yes, it’s always been the standard solvent, mainly because it’s an excellent cannabinoid extractor. However, pure alcohol like Everclear is expensive, highly flammable, and not everyone’s cup of tea. 

     

    It’s 2017, and there’s a new solvent you can, and should, use—glycerin, a common food ingredient that’s 100% safe to consume (unless you’re vaporizing it in high temperature, that’s a whole other topic of debate). You can buy it on Amazon or at Wal-Mart and won’t need more than an 8 ounce bottle.

     

    We’ll use cold maceration (extraction) since it preserves the terpenes and the integrity of the flower. Plus, glycerin’s sweet flavor makes it the perfect additive for baked goods and other sweets; it even tastes like a kiddie treat when ingested!

     

    Admittedly, a glycerin tincture is slightly less concentrated than the traditional alcohol-based one, but taking a slightly larger dose will get you to the same place.

     

    Follow these simple steps to make your own tincture:

     

    1. Grind at least 1 oz your high-CBD flower shake and nugs (kief optional) as finely as possible using a blender or coffee grinder, depending on the amount.
    2. Put your powdered cannabis and the glycerin into a glass jar, preferably a mason, and seal tightly.
    3. Position the jar on a window sill, constantly exposing it to sunlight, and let it marinate for 4-5 weeks (the longer the better). Once a day shake it to stimulate the cannabinoids.
    4. After the given time has passed, strain the tincture through a sieve or cheesecloth to remove the extracted cannabis. Don’t use a paper coffee filter.
    5. Finally pour the tincture into a dropper bottle, keep it refrigerated, and you’re good to go!

     

    While it does take a long time to make, it’ll be worth the wait as this glycerin cannabis tincture is rich in terpenes, taste, and healing power.

He’s as close as conceivably possible to being canonized the official patron saint of stoners. But even if you’re not a weed aficionado, you know him as one-half of the iconic ‘70s & ‘80s stoner comedy duo, Cheech & Chong.

     

    And like many other popular public figures who indulge in the herb, he’s come out with his own line of cannabis products. We gotta say, watching this industry explode with innovation and competition is thrilling, and Tommy’s line of products is a potent addition to the mix.

     

    In this detailed Chong’s Choice review, we’ll examine the who, what’s, when’s, where’s, and why’s of Chong’s products so that you can decide for yourself whether they’re up your alley, or if you should pass on that green.

    Why Did Tommy Chong Start a Cannabis Line?

     

    The only surprising thing about Chong launching his own brand of cannabis products, Chong’s Choice, co-founded with his son, Paris Chong, in 2015, is that he didn’t do it way sooner. With a name as recognizable in the world of cannabis as Tommy Chong, his products have some pretty big shoes to fill.

     

    Perhaps to make up for lost time, Chong Choice’s array of products—flowers (solid in individual eighth jars), pre-rolls, vaporizers, vape cartridges, and edibles—is specialized, diverse, and initially offered in the three classic strain types: sativa, indica and hybrid.

     

    Not only did Tommy Chong inevitably become a pro-cannabis activist due to his pioneering roles in the stoner comedy genre, but also because he has survived two bouts of cancer (prostate and bowel), which cannabis has personally helped him overcome when combined with traditional treatments.

     

    Chong’s come a long way, and in our eyes, has done a lot of good for the industry. But his claim to fame hasn’t been without its hiccups.

     

    In 2003, a government sting that focused on drug paraphernalia targeted a glass pipe and bong company owned by Paris, which ultimately sent his father Tommy to jail for nine months (possibly to make an example out of him since he’s highly visible in the cannabis world), included a fine of $20,000 and the forfeiture of almost $120,000 in assets, not to mention the loss of the domain name, tommychong.com.

     

    Of course today the laws surrounding marijuana and its paraphernalia are far more lax and are growing more so every year, meaning that Chong’s Choice is unlikely to face the same criminal persecution its namesake did more than ten years ago.

     

    Chong’s Choice Product Line

     

    1/8th Flower Jar

    Paris has taken an active role in Chong’s Choice strains, selecting the bud varieties used in their products alongside his father. Strangely enough, no official source lists the specific strains utilized in each of Chong’s Choice’s sativa, indica and hybrid offerings.

     

    These eighths are sold in individual, reusable glass containers, which look great and are a far more attractive alternative to the sterile-looking prescription bottles that are the default at most dispensaries.

     

    A SFGate review lists My Friend Jack, Chong Daddy Purple, and Chong’s Choice OG Kush as the strains utilized in each cannabis product; The Cannabist lists Durban Haze, Blue Dream and Grape Stomper; and the Shango line of dispensaries in Nevada, Oregon and Washington seems to sell a sativa called Bruce Banner unmentioned elsewhere.

     

    This variance is probably due to the fact Chong’s products are available in multiple states, and different suppliers provide different strains for the brand.

     

    It could be that they cycle through different strains from harvest to harvest, or simply alternate strains depending on the marketplace, since they’re currently distributing to dispensaries in six different states (Arizona, California, Colorado, Montana, Oregon and Washington).

     

    The only verbiage pointing toward a definitive answer on the official website describes all of their bud as locally grown and sourced; so for now you’ll have to consult your local dispensary for accurate information.

     

    Even still, hopefully we’ll get some clarification sooner or later as to which strains are available where. After all, what we as consumers need is more transparency, not less, about what’s in the products we’re consuming.

     

    Here’s what we do know about Chong’s Choice’s flowers: they get the job done.

     

    Possibly due to the commitment by Tommy and Paris Chong to never charge a premium price for their products, these aren’t quite top shelf buds by our standards, but to most customers this will hardly matter.

     

    Chong’s Choice’s buds are great, and come trimmed and dried to perfection. All signs point toward lots of care being put into building a quality product.

     

    Pre-Rolled Joints

    Each Chong’s Choice pre-roll contains 0.75g of cannabis and is individually packaged in its own plastic tube to keep it fresh. Joints are sold in packages of five that resemble a bizarro pack of cigarettes, which may very well become the norm as legalization hits more parts of the country.

    Does Hemp Oil Contain CBD?

    True cannabis oil is derived from psychoactive varieties of Cannabis Sativa. As a result, it can contain both CBD and THC, or can isolate either one or the other.

     

    The presence of cannabinoids can present both advantages and disadvantages depending on a patient’s needs and circumstances.

     

    For instance, potential drawbacks of marijuana oil compared to CBD hemp oil (which we’ll get to shortly) include:

     

    • May test positive on workplace drug test.
    • THC high is not ideal for some patients.

    The reason for this, scientists now believe, is that cannabis consists of hundreds of substances–including THC, cannabinoids, terpenes, and many more–which work together synergistically and holistically to create an effect that goes beyond any one compound in the plant.

     

    As Dr. Sanjay Gupta explains, “When the drug [Marinol] became available in the mid-1980s, scientists thought it would have the same effect as the whole cannabis plant. But it soon became clear that most patients preferred using the whole plant to taking Marinol. Researchers began to realize that other components, such as CBD, might have a larger role than previously realized.”

     

    Thus, the presence of compounds like terpenes impacts how CBD and other cannabinoids interact with the body.

     

    For example, terpenes inhibit some CBD receptors in the brain but promote binding in others, which affects how cannabinoids are absorbed. This is one reason that marijuana oil–which can contain CBD, THC, and other cannabinoids–is always more useful than hemp oil.

    • Marijuana oil offers the entourage effect.

  • Thought the Elections Were Over? Not if You Live in Los Angeles!

    On March 7, 2017, Los Angeles City voters will be choosing new candidates to run their city and voting on several ballot measures. Two of these measures would allow the city to regulate cannabis businesses in response to the recent passage of Prop 64, which legalized the recreational use of marijuana in California.

     

    These two are Measure M and Measure N.

    Measure N: the Initiative That Sparked Measure M

     

     

    Measure N is a citizen’s initiative that was created and qualified by several of the cannabis business owners operating under L.A.’s current limited immunity rules.

     

    Measure N would establish specific rules for the commercial regulation and taxation of marijuana in L.A. and would prevent the council from making any additional changes to the regulations without specific approval from the voters. In short, Measure N would:

     

    • Give priority licensing to the current established medical marijuana dispensaries that are complying with existing law.
    • Maintain 135 dispensaries and allow the City Council to increase the number of dispensaries but not decrease them.
    • Allow the city to issue Medical Cannabis Regulation and Safety Act (MCRSA) related permits including manufacturing, cultivation, and sale.
    • Limit enforcement options against permit holders who violate the operational standards and guidelines.
    • Allow sales of recreational marijuana by permit holders at an 8% tax rate.

     

    Because Measure N also takes power away from the city to make certain changes to these laws, a voter initiative would be required if changes became necessary.

     

    A Two-Tiered Enforcement System?

     

     

    Measure N also creates a two-tiered enforcement system for violators of the city’s regulations. This system would establish criminal penalties for those who don’t hold licenses, but only allow for a misdemeanor to be levied against permit holders who violate these same regulations after a series of other penalties are levied:

    • 1st violation: a correction letter
    • 2nd violation: a two year period of infraction
    • 3rd violation: a two year period of permit suspension
    • 4th violation: misdemeanor

     

    Therefore, the initiative would allow for criminal penalties to be levied against non-permit holders only. It’s possible this type of enforcement system would face legal review.

     

    The proponents of Measure N have now abandoned their support of the initiative in favor of the city’s counter-initiative—Measure M.

     

    Measure M: the Council’s Counter-Initiative

     

     

    Measure M was created by the City Council in response to the qualification of Measure N. Since the City Council’s countermeasure seems to strike a compromise that the proponents of Measure N found acceptable, they have abandoned Measure N and thrown their full support behind the City Council’s Measure M.

     

    Measure M will give the City Council the power to tax and regulate Los Angeles’s marijuana industry under the rules of Prop 64, which is now law.

     

    Unlike Measure N, with Measure M the City Council will retain the authority to amend existing regulations and adopt new ones. But there’s a catch—they must conduct public hearings with the citizens first.

     

    These public hearings will focus on commercialization of recreational and medical cannabis, and how license applications for current compliant businesses will be processed, among other topics.

     

    Measure M will also authorize:

    • New criminal penalties for violations.
    • New nuisance abatement rules.
    • Increase in fines for use of power and water with non-compliant cannabis activity.
    • Disconnection of power and water for non-compliant cannabis activity.
    • New business taxes which include:
      -A 10% tax on gross recreational sales.
      -A 5% tax on gross medical sales (this is a 1% reduction from the current level).
      -A 1% tax on transportation, testing or research sales.
      -A 2% tax on manufacturing, cultivation and other commercial activity.

     

    Why Are These Measures Necessary? Isn’t It Already Legal?

     

    With the passage of the Medical Cannabis Regulation and Safety Act by the state legislature and Prop 64 by the people, Los Angeles’s current rules under Proposition D are no longer compliant with state law.

     

    Measure D was a simple limited immunity measure. Basically it provides prosecution immunity to a select group of people who were legally operating cannabis dispensaries before a certain date—IF they followed a specific set of rules.

     

    Since the state now requires dispensary applicants to show proof of city licensing or other positive approval of operations, an agreement not to prosecute does not qualify L.A.’s current operators to apply for a state license. Additionally, specific licenses are necessary for cultivation, transport, testing, manufacturing and other activities.

     

    Los Angeles must pave the way for new business licensing if cannabis businesses are to survive in the city under the new state regulations.

     

    Why Didn’t L.A. Offer Business Licenses in the First Place?

     

     

    Los Angeles, like many other California cities and counties, was reticent to issue business licenses to dispensaries because marijuana is still considered illegal on a federal level. These attitudes are changing now as medical marijuana is legal in more than half the states in the U.S., and is fully legal in seven states and Washington D.C.

     

    Council president Herb Wesson spearheaded the effort to put the countermeasure on the ballot, which is now endorsed by Police Chief Beck and Police Union head, Craig Lally.

     

    With the passage of Prop 64, many local municipalities are jumping to ensure they have taken full control of their licensing authority before the state begins handing out official business licenses in 2018.

     

    Others are working just as hard to ensure that marijuana businesses will not be allowed at all in their communities. Long story short—Los Angeles wisely opted for regulation.

  • What Trump’s Administration Means for Cannabis: Part 1

    The following is the first part of a series of articles that will document the actions of the Trump administration regarding marijuana law during the first 100 days of his administration. We will also interview several community activists to showcase differing opinions about the direction of the administration’s policies.

     

    In this first segment, activist Lanny Swerdlow discusses his observations of partisan politics in regards to medical marijuana and hopes for upcoming Democratic party action in California. Mr. Swerdlow was a member of the group that sued the state to stop local bans on dispensaries in the now infamous Riverside decision. He didn’t give up after the state’s Supreme Court ruled against him, but doubled down instead.

     

    He is now head of the Brownie Mary Democratic Club and was instrumental in convincing the state party to support legalization.

     

    There’s a lot of confusion seeping its way through the cannabis world at the moment. The industry should be celebrating its wins as 4 more states fully legalize recreational cannabis (total of 8 now, plus District of Columbia). Yet, you can still see some shifty eyes at the after party, warily scanning the latest headlines for signs of the impending cannapocalypse.

     

    Registered nurse and Democratic cannabis activist Lanny Swerdlow is not willing to wait and scan the headlines. He sees which way the wind is blowing. So he’s planning political counter-strikes with his fellow activists in case the Trump administration starts cracking down on the industry.

    Trump Appoints Anti-Cannabis Staff

     

     

    It appears these precautions may be well-founded. Our new president seems to be appointing quite a few anti-cannabis–well let’s just say for lack of a better word–“zealots” to higher office.

     

    For instance, Trump gave the nod to Georgia’s Tom Price for Secretary of Health and Human Services. For those who don’t know who Price is, he’s a staunchly anti-cannabis Representative from Georgia who voted against almost every single pro-marijuana reform pitched by Congress.

     

    Trump has also nominated Neil Gorsuch (a Reagan Republican favorite) for Supreme Court. Most are saying that Gorsuch is an enigma in the area of cannabis, but his court decisions speak on the issue even if his words don’t.

     

    Gorsuch validated the fatal use of a taser by a Colorado police officer based on the logic that the victim was illegally growing marijuana, so he might be armed. He also dismissed a religious defense for use and distribution of marijuana because the defendants “don’t sincerely hold religious beliefs they claim to hold, but instead seek to use the cover of religion to pursue secular drug trafficking activities.”

     

    Some are holding on to their optimistic outlook, counting on Gorsuch’s pro-states’ rights stance, but Swerdlow disagrees with such optimism by pointing out Republican hypocrisy when it comes to states’ rights.

     

    Nugg: What about Trump’s Supreme Court pick?

     

    Swerdlow: Well, that could be a problem. These Republicans are supposed to be states’ rights advocates, but when it comes to marijuana their states rights advocacy goes up in smoke.

     

    Nugg: What do you think the logic is for back-peddling on states’ rights when it comes to marijuana?

     

    Swerdlow: Because this is marijuana!! It’s a matter of them just using Libertarian states’ rights as an excuse to pass what they want–something they favor like voter suppression and equal rights–and then they don’t impose it when it’s something that they don’t want to pass. They’re hypocrites.

     

    Jeff Sessions as Attorney General

     

     

    The Supreme Court pick isn’t even the cannabis community’s largest concern, believe-it-or-not. Trump’s selection for Attorney General is striking fear in the hearts of activists everywhere.

     

    Senator Jeff Sessions, who has just been sworn in as our new AG, [Feb. 9, 2017] is known to be one of the most fanatical Regan-era, anti-cannabis despots in the nation.

     

    He continuously tries to “correct” public perceptions on his zealotry against the plant, saying that his opinions are being misconstrued.

     

    But his choice of words set his opinions in stark relief, with statements like, “Good people don’t smoke marijuana” and, “It is false that marijuana use doesn’t lead people to more drug use. It is already causing a disturbance in the States that have made it legal.”

     

    Some terminally optimistic activists cite Sessions’ statement at his confirmation hearing as a sign that he might be starting to mellow out on the green:

     

    “One obvious concern is that the U.S. Congress has made the possession of marijuana in every state, and distribution of it, an illegal act. So, if that’s something that is not desired any longer, Congress should pass a law that changes the rule. It’s not so much the Attorney General’s job to decide what laws are enforced, we should do our job and enforce laws effectively as we are able.”

     

    But it’s quite possible that Sessions feels safe saying this because he is confident that Congress doesn’t have the stomach to take on true cannabis law reform.

     

    In a recent interview with Fortune magazine, Mark A. R. Kleiman of NYU agrees with this sentiment, saying, “It’s simply not moving through the legislatures and I don’t know what it would take for Congress to act. The position of the Trump campaign was that this was a matter to be left to the states, but in order to leave it to the states you actually need Congressional legislation.”

     

    The Rohrabacher-Farr Amendment Prevents Federal Interference 

     

     

    Swerdlow is hoping that Congress will start addressing the issue by renewing the 2014 Rohrabacher-Farr amendment on April 28th, but he isn’t holding his breath.

     

    Nugg: Can you tell us more about what is going to happen on the 28th with the Rohrabacher–Farr amendment?

     

    Swerdlow: This is an amendment to the Department of Justice funding bill. What it does is it denies funding to the Department of Justice to conduct any activities that impose federal [marijuana] law on states that have their own medical marijuana systems. The Obama administration has taken that to also mean recreational marijuana. It will at least keep Sessions from doing anything to medical marijuana. The question that everyone has is, “Are they [Congress] going to renew that amendment?” The way it got passed before is that 90% of the Democrats and 25% of the Republicans voted in favor of it. That was enough votes to enact it, but if Sessions and Trump put pressure on the Republican legislators not to vote for it this time, and if it doesn’t pass, that means Sessions is free to go in and do whatever he wants.

     

    Nugg: What’s your estimation of the danger of that happening?

     

    Swerdlow: I don’t know. I really don’t know. The real question is, “Is Trump going to stop Sessions from doing anything?” During the Trump campaign back in 2015 he said it should be left to the states. He hasn’t said very much about it since then. I’m hearing both sides. I’m hearing “Yeah, he’s going to leave it to the states,” or “No, he’s gonna let Sessions come in and start smashing heads.” I’m very concerned about Sessions’ statements. I think he’s left the door wide open for people to come in and start busting people.

     

    Nugg: What do you think the worst case scenario is here and what do you think is the best case scenario?

     

    Swerdlow: Well, the best case scenario is that Trump honors what he said during the campaign and he lets the states make their own decisions with no Federal interference–kind of like President Barack Obama was doing. The worst case scenario is if Trump says Sessions can go ahead and go after it. You know, there’s a lot of lawyers in the Department of Justice who are doing all this work on Wall Street and investment bankers and also on environmental issues, and Trump’s going to pull all these lawyers off these cases. He’s not going to want any kind of these investigations going on. So, Sessions is going to have all these lawyers with nothing to do, and he’s going to assign them to go into states that have cannabis laws and start filing lawsuits against all distributors and maybe even against some state agencies and states officials.

     

    Nugg: If that happens, do you think that there’s a chance that the states could end up going backwards away from legalization?

     

    Swerdlow: That depends on what happens in California, which is the big boy. I think Sessions is going to go after California first because if he can take out them, he’ll have no problem taking out the other states.

     

    Organizing the Activists

     

     

    And Swerdlow isn’t just sitting on the sidelines complaining about Trump’s picks or playing armchair quarterback. He’s helping to instigate a plan of action in case the community needs to fight back.

     

    Swerdlow: I think it’s a matter of hope for the best and prepare for the worst, but we need to start preparing right now. If we’re prepared, and they go ahead and extend the amendment, then we can say, “Ok, we don’t have to worry about it any more.” But if we don’t start preparing now and bad things start happening, you don’t want to start organizing after they have started moving against you. You want to be prepared so when they start, you are ready to take them on.

     

    Nugg: What would be your first step to start organizing?

     

    Swerdlow: In 1996 when 215 passed, the DPA was the one that was behind it, but as soon as it passed, they packed up up their bags and left town! The medical marijuana community didn’t know what the [bleep] to do! They should have been on the doorsteps of the State Legislature the day after it passed, banging on the doors and demanding implementation. But nothing happened for 8 years.

     

    People were still getting busted and everything was underground. It didn’t change until 2004 when Senate Bill 420 got passed. Now the DPA has learned their lesson and they are staying around. They’ve left two people to help implement legislation and defend Prop 64.

     

    We’ve got Lynne Lyman. She’s the California director. And then they have the special person by the name of Cat Packer. She’s the California Public Policy director for Drug Policy Alliance Los Angeles. She was at our MAPP meeting on Wednesday and we were talking about…Sessions and what they’re going to be doing.

     

    They [the DPA] are drafting what is called noncompliance legislation. This is is kind of like sanctuary cities, where the cities tell their police [not to] cooperate with the Feds when they come in here to arrest immigrants.

     

    This [cannabis] non-compliance legislation can be passed by the state legislature and it will direct the state government, state agencies, counties, and cities to not cooperate with the Feds if they come in here to bust state regulated marijuana distributors.

     

    If it passes, that will cause the Feds a lot of problems because when the DEA comes in here and makes a raid they have two or three agents and a dozen or more local cops to help them do it. If they can’t get local cops to help them, they’re going be less able to do anything.

     

    Nugg: How can the average person help with this effort?

     

    Swerdlow: The cops will be putting enormous pressure on the legislature not to pass that law. We have to start organizing now so when that piece of legislation gets introduced, we are putting pressure on our State Assembly members and our State Senators telling them to pass it. If we do what we usually do and don’t get involved, then when it doesn’t pass and the Rorabacher-Farr amendment doesn’t pass, we’re going to get screwed. The medical marijuana community has never been politically active. I am trying to drag them kicking and screaming into political activism.

     

    Swerdlow hopes to enroll the Democratic party in this effort as well through the Democratic Brownie Mary Club.

     

    Swerdlow: I am drafting a resolution to introduce at the Democratic State Convention in May that will put the Democratic party in support of this legislation. I think the DPA has a couple of state legislators poised to introduce the bill. Getting it introduced isn’t the problem. The problem is getting it through the committees and getting it passed.

    While there are some challenges for sensible cannabis regulation in the near future, no one has a crystal ball that will predict exactly where President Trump’s administration will land on the issue in the end.

     

    Our efforts as private citizens may have more effect on the shape of upcoming legislation than at any other time in history. This is why it is so important to use the links above, even if the only action we have time to take is to voice our opinions with our legislators.

     

    The Federal government is clearly reassessing their stance on cannabis law in light of the fact that it is now legal in more than half the states in the nation, and we will shape their new position.
