About Medical Marijuana in Illinois

Illinois recently joined the ranks of states to legalize marijuana for recreational and medical users. In January 2020, they officially became the 11th U.S. state to have done so. Interestingly enough, no state had ever legalized recreational cannabis sales through their state legislature before Illinois. Technically, Vermont legalized recreational marijuana through their legislature first, but their laws did not allow for actual sales until after Illinois.

Illinois has been leading the charge to provide marijuana as an alternative to opiates. The state launched its pilot program in 2018 to direct residents towards using cannabis as an opiate replacement. The program was designed to decrease the number of deaths caused by opiates in Illinois. The state made this program permanent in 2019 while also adding many additional qualifying medical conditions.

Illinois taxes medical marijuana at 1%. The rates for recreational cannabis are dependent on the potency of the product: If THC is less than 35%, the tax rate is 10%. For infused products like edibles, the tax rate is 20%. If THC is more than 35%, the tax rate is 30%.

Keep in mind that there is a 6.25% state sales tax. Local taxes could apply as well. This means that Illinois residents (recreational users) can pay up to 19.5% to 34.7% in retail taxes. Medical marijuana patients have to pay a far smaller tax rate. Not only that, they are authorized to cultivate no more than 5 cannabis plants. So, there are significant advantages to having a medical marijuana card in Illinois.

More About Illinois

By population, Illinois is the United State's sixth largest state. The state ranks 5th in gross domestic product. Chicago, the largest city, is both a major transportation hub and a major industrial hub. Their largest airport, O'Hare serves as a major international travel center as well. The Mississippi River and Great Lakes connect the state's waterways to international ports on both the northern and southern borders and provide cargo access to the entire Mid West.

The state capital, Springfield, is home to the Abraham Lincoln Presidential Library and Museum, preserving the history of the President's life and leadership. Oak Ridge Cemetery and the Lincoln Tomb are another popular destination for history lovers.

Further south, visitors can take in the jazz scene in East St. Louis or travel to the Gateway Arch to take in the incredible view. Six Flags is also a popular destination in the area, along with the river cruises for music and fine dining.

What are the typical dosages of cannabis?

Many times, marijuana products will be sold in 10 mg doses. Nevertheless, if you're a first-time user, be aware that this dosage may be too high for you. Don't hesitate to use a smaller dose for your first time using marijuana.

Illinois doesn't allow its residents to use marijuana in public places, which also applies to front porches. Patients and residents cannot use cannabis in motor vehicles either. Cannabis use is limited to private homes for the most part.

No, absolutely not. Driving a motor vehicle after using marijuana is still a crime in Illinois. It is dangerous to do so and could cause a potentially life-threatening car accident. Driving under the influence can also result in DUIs for those residents caught doing so.

Can visitors from other states buy cannabis in Illinois and transport it back across with them?

No, they absolutely cannot. Transporting cannabis across state lines is a federal offense. Out-of-state visitors are allowed to purchase cannabis, however, if they are over 21. They cannot bring any of the cannabis back home, though. These visitors can buy up to 15 grams of flower, 2.5 grams of extracts, or 250 mg of THC derivatives.

How much cannabis can patients and residents possess in Illinois?

If an Illinois resident is 21 years or older, they can possess up to the following:
* 30 grams (1 ounce) of cannabis flower
* 5 grams of cannabis extracts (oils, dab, or kief)
* 500 milligrams of THC derivatives (edibles, tinctures, lotions)

Medical marijuana patients, on the other hand, can possess 2.5 times these amounts.

Who is allowed to cultivate cannabis in Illinois?

Illinois sets limitations on who can grow marijuana. Right now, only medical marijuana patients are allowed to cultivate. Each is allowed no more than five cannabis plants.
